1. Acceptance of Terms

By downloading, accessing, or using the Syntexa mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Syntexa is an AI-powered communication assistant that helps users craft messages and improve their communication skills across dating apps, social media, and everyday conversations. The App provides suggestions and guidance but does not guarantee specific outcomes in your personal or professional communications.

4. User Accounts

To use certain features of the App, you must create an account using your email, Google, or Apple sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to use the App to:

Harass, abuse, threaten, or harm others
Send spam, unsolicited messages, or bulk communications
Engage in fraudulent, deceptive, or manipulative practices
Generate content that is illegal, hateful, or sexually explicit
Violate any applicable laws or regulations
Impersonate another person or entity
Attempt to gain unauthorized access to the App or its systems
Use the App for any commercial purpose without our written consent

6. Subscriptions and Auto-Renewal

Syntexa offers both free and premium (Pro) subscription tiers.

Free tier: 5 AI response credits per week (resetting every Monday) and 10 Syntexa Chat messages per 8-hour window.
Pro tier: Unlimited AI responses, 50 Chat messages per 8-hour window, and weekly insights.

Pro subscriptions are billed through the Apple App Store (iOS) or Google Play Store (Android). Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription in your device's account settings (iOS: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions).

7. Credits

Free users receive 5 credits per week, resetting every Monday. Bonus credits earned through referrals do not expire and are used after weekly credits are exhausted. Credits cannot be transferred, sold, or exchanged for cash. Unused weekly credits do not roll over.

8. AI-Generated Content

Message suggestions provided by the App are generated by artificial intelligence. While we strive for helpful and appropriate suggestions, we do not guarantee their accuracy, completeness, or suitability for any purpose. You are solely responsible for reviewing, editing, and deciding whether to send any messages suggested by the App. We are not liable for any consequences resulting from messages you choose to send.

9. Intellectual Property

The App and its content, features, and functionality are owned by Syntexa LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

10. User Content

You retain ownership of the messages, screenshots, voice recordings, and other content you submit through the App. By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving our services. We do not use your personal content for AI model training.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED SUGGESTIONS WILL BE ACCURATE OR APPROPRIATE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNTEXA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM AI-GENERATED CONTENT, LOSS OF DATA, OR INTERRUPTION OF SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Delaware. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Apple & Google Terms

If you access the App through the Apple App Store, you acknowledge that these Terms are between you and Syntexa LLC, not Apple. Apple has no obligation to furnish maintenance or support services for the App. In the event of any failure of the App to conform to applicable warranties, Apple's sole obligation is a refund of the purchase price (if any). Apple is not responsible for addressing any claims relating to the App. If you access the App through Google Play, the Google Play Terms of Service apply in addition to these Terms.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and on our website. Your continued use of the App after such changes constitutes acceptance of the new Terms.

16. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time through the in-app account settings. Upon termination, your right to use the App ceases immediately.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
